Paul and Amelia Jane Schwalm.1,2 Preston Daniel Paul married Minnie Donton, daughter of Hiram Donton and Emma Laing.1,4 Preston Daniel Paul married Minnie Margaret Gongloff, daughter of Jacob Gongloff and Mary Neidlinger, before 1924.6,7 On the death of his second wife, Minnie (Gongloff) Paul, in 1942, her will gave her entire estate to a son from her first marriage, Clyde Weaver, and entirely excluded her second husband, Preston. Preston exercised his right as a surviving spouse to take against the will.
As a newspaper article explained:
Porter Twp. Man Elects To Take [Against] Will Of Wife
Cut off by the will of his wife, Minnie Weaver Paul, Orwin, who died March 25, 1942, Preston Paul of Porter Twp., has filed his election to take against the will and share in the same manner as if his wife died without a will.
Mrs. Paul gave her entire estate including a 2Vss story frame dwelling to her son, Clyde Weaver, and named Squire Leroy Kaufman, Tower City, as executor.
By taking against the will the husband will share the estate and receive one half of the same including a nominal amount of personal property. Atty. J. G. Seesholtz, is representing Paul.
A wife [or] the husband cannot cut off the one or the other without at least the amount as allowed by law. A parent however can cut off a child and in many instances $1 is given so as to remove any grounds for a will contest on the basis that the testator overlooked the same.8 Preston Daniel Paul died on 27 March 1961, Porter Township, Schuylkill County, PA, at age 76.4,5
